Welcome to BYDAZED. By accessing or using bydazed.com (the "Store"), you agree to these Terms of Service ("Terms"). Please read them carefully.

/ 1. General Terms

1.1 Agreement to Terms

By using the Store, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, do not use the Store.

1.2 Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Store after changes are posted constitutes acceptance of the new Terms.

1.3 Eligibility

You must be at least 16 years old to make a purchase. By placing an order, you represent that you meet this age requirement and that all information you provide is accurate.

2.1 Product Descriptions

We make every effort to display our products as accurately as possible. However, colors may vary slightly depending on your screen settings.

2.2 No Restock Policy

All BYDAZED products are released in limited quantities as part of scheduled drops. Once a product sells out, it will not be restocked. This is a core part of our brand philosophy.

2.3 Pricing

All prices are listed in USD and are subject to change without notice. The price you pay is the price displayed at the time you complete your order.

2.4 Print-on-Demand

Our products are made-to-order using print-on-demand fulfillment. This means:
  • Your item is produced only after you place your order
  • Production typically takes 2-5 business days before shipping
  • Each item is custom-made and cannot be returned unless defective (see Refund Policy)

/ 3. Orders and Payment

3.1 Order Acceptance

Your order is an offer to purchase. We reserve the right to accept or decline your order for any reason, including product availability, errors in pricing or product information, or suspected fraud.
You will receive an order confirmation email once your order is accepted. This email does not mean your order has shipped — you will receive a separate shipping confirmation when your item is dispatched.

3.2 Payment

Payment is processed securely through Stripe. We accept major credit and debit cards. Payment is charged at the time you place your order.

3.3 Order Cancellation

Because our products are made-to-order, orders cannot be canceled once production has begun (typically within 1-2 hours of placing your order). If you need to cancel, contact us immediately at [email protected].

/ 4. Shipping and Delivery

4.1 Shipping Locations

We currently ship worldwide through our fulfillment partner, Gelato.

4.2 Shipping Costs

Shipping costs are calculated at checkout based on your location. A flat shipping fee of $14.99 USD applies to most orders.

4.3 Delivery Times

  • Production: 2-5 business days (print-on-demand)
  • Shipping: 5-14 business days (depending on destination)
  • Total estimated time: 7-19 business days from order placement
Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by customs, holidays, or carrier issues.

4.4 Customs and Import Duties

International customers may be subject to customs duties, taxes, or fees imposed by their country. You are responsible for paying these charges. BYDAZED has no control over these fees and cannot predict their amount.

4.5 Lost or Stolen Packages

We are not responsible for packages marked as "delivered" by the carrier. If your package is lost or stolen after delivery, please contact the shipping carrier directly.

Summary:
  • No returns or exchanges on made-to-order items (due to the custom print-on-demand nature)
  • Defective or damaged items: Handled according to Gelato's quality and delivery guarantee
  • Wrong item received: Contact us within 14 days for a replacement

/ 6. Intellectual Property

6.1 Ownership

All content on the Store — including but not limited to logos, graphics, designs, text, images, and the BYDAZED name — is the intellectual property of BYDAZED and is protected by Norwegian and international copyright, trademark, and intellectual property laws.

6.2 Restrictions

You may not:
  • Copy, reproduce, distribute, or create derivative works from any Store content without our written permission
  • Use our trademarks, logos, or brand name without authorization
  • Reverse-engineer, decompile, or attempt to extract source code from the Store

6.3 Your Use

When you purchase a BYDAZED product, you acquire ownership of the physical item only. You do not acquire any rights to the designs, artwork, or intellectual property depicted on the product.

/ 7. Prohibited Uses

You agree not to use the Store to:
  • Violate any laws or regulations
  • Impersonate another person or entity
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Harass, abuse, or harm other users
  • Use automated tools (bots, scrapers) to access the Store without permission
  • Place fraudulent orders or use stolen payment information
We reserve the right to suspend or terminate your access to the Store if you violate these Terms.

/ 8. Limitation of Liability

8.1 No Warranties

The Store and all products are provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Limitation of Damages

To the fullest extent permitted by law, BYDAZED shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Store or purchase of products, even if we have been advised of the possibility of such damages.

8.3 Maximum Liability

Our total liability to you for any claim arising from your use of the Store or purchase of products shall not exceed the amount you paid for the product in question.

8.4 Norwegian Law

Some jurisdictions (including Norway and the EU) do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, the above limitations may not apply to you, and you may have additional statutory rights.

You agree to indemnify, defend, and hold harmless BYDAZED, its owners, employees, and partners from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
  • Your use of the Store
  • Your violation of these Terms
  • Your violation of any third-party rights (including intellectual property rights)

/ 10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

10.2 Jurisdiction

Any disputes arising from these Terms or your use of the Store shall be subject to the exclusive jurisdiction of the courts of Lillehammer, Norway.

10.3 Informal Resolution

Before filing a formal legal claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally.

/ 11. Consumer Rights (Norway / EU)

If you are a consumer located in Norway or the European Economic Area, you have certain statutory rights under Norwegian and EU consumer protection law that cannot be waived by these Terms, including:
  • Right to a conforming product (free from defects)
  • Right to a reasonable warranty period
  • Right to return defective goods for repair, replacement, or refund
  • Right to cancel certain distance sales contracts (note: custom-made goods are generally excluded from cancellation rights under Norwegian and EU law)
Nothing in these Terms limits your statutory consumer rights.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BYDAZED regarding your use of the Store.
